Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Yieldly mobile application and the yieldly.org website (together, the "Service"), operated by Googly, LLC ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use.

Googly, LLC operates multiple applications. These Terms apply only to Yieldly; other Googly apps may have separate terms.

1. The Service

Yieldly is an informational tool for dividend investors. It lets you discover dividend-paying stocks, track portfolios and watchlists, view a dividend calendar, analyze dividend data, forecast income, and receive optional dividend alerts. Signing in enables secure cloud storage and synchronization of your portfolio and watchlist data across devices.

2. Eligibility and accounts

• You must be at least the age of majority in your jurisdiction, or have the consent of a parent or guardian, to use the Service.
• Account sign-in uses email-based one-time passcodes (OTP). You are responsible for maintaining access to your email and for activity under your account.
• You agree to provide accurate information and to notify us promptly of any unauthorized access.

3. Subscriptions (Yieldly Pro)

• Certain features require a paid subscription ("Yieldly Pro"). Subscriptions are sold and billed through the Apple App Store or Google Play, subject to their terms.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store or Google Play account settings.
• Where a free trial is offered, it converts to a paid subscription unless cancelled before the trial ends.
• Except where required by law or store policy, payments are non-refundable. Refund requests are handled by Apple or Google.
• Pricing and features may change; we will provide notice where required.

4. Acceptable use

• Use the Service only for lawful purposes and as intended.
• Do not reverse engineer, disrupt, overload, or interfere with the Service or its security.
• Do not attempt to access accounts or data that are not yours, or misuse the authentication system.
• Do not scrape, resell, or redistribute data from the Service except as expressly permitted.

5. Your content

You retain ownership of the data you enter, such as holdings and watchlists. You grant us a limited license to store, process, and display that data solely to provide the Service to you. You are responsible for the accuracy of the data you enter.

6. Third-party services and data

The Service relies on third-party infrastructure and service providers (for example, cloud hosting, authentication, analytics, notifications, subscription billing through your app store, and licensed market data). Your use of the Service may also be subject to those providers' terms where applicable. We are not responsible for third-party services or the accuracy of third-party data.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or complete.

8. Limitation of liability

To the fullest extent permitted by law, Googly, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or investment losses, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us, if any, in the 12 months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. You can delete your account and associated data from Settings → Delete Account in the app.

10. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles, except where local law requires otherwise.
